SIPTU members employed as security officers by G4S Secure Solutions Limited on a contract to supply security services to South Dublin County Council have served strike notice on their employer in a dispute concerning transfer of undertakings regulations.
The workers will commence strike action on Tuesday, 17th February, with pickets being placed outside the South Dublin County Council facilities where they are deployed.
SIPTU Organiser, Peadar Nolan, said: “The action is being taken as a result of the refusal of the incoming contractor Top Security Limited to apply the European Communities (Protection of Employees on Transfer of Undertakings) Regulations 2003 (TUPE). This failure to comply with these regulations will result in a situation where G4S cannot guarantee our members their jobs at their normal place of work, and places them at risk of compulsory dismissal. The incoming contractor is also refusing to engage with this union which represents the workers involved.
“This is contrary to the recognition of the ‘right to transfer and continuance of employment’ for security guards by the vast majority of employers in the industry. The TUPE regulations are crucial to protecting jobs; standards and maintaining what are already the relatively low rates of pay in this industry.”
He added: “SIPTU and our members are deeply disappointed that those responsible for the awarding of the contract in South Dublin County Council have not insisted on compliance with the regulations. We have also requested the intervention of the council to make sure there is engagement by the parties to resolve the matter but this has been to no avail.
“These workers have served the council well in protecting and securing its sites. This matter can be resolved if the council intervenes and insists that Top Security Limited complies with transfer undertakings regulations and engages with SIPTU immediately.”
